Crisis of law or genesis of a new legal culture?

Based on the current debate on the crisis of law – as addressed in our Horizon Europe proposal ‘Rule of Law Compliance: Crisis of the Law?’ – we want to look beyond the processes of erosion of the old European concept of law.

We also focus on the thesis that we may be witnessing the emergence of a new legal culture and a new culture of validity in which power is increasingly becoming the sole basis of its validity.

The semantics of legal culture should make it possible to describe and explain normative orders precisely – detached from simplistic judgements – as required for a culturally inspired and critical analysis of law.

The aim is to shed light on changes in perspective and develop new analytical concepts – beyond neo-imperialism, neo-colonialism, neo-fascism etc. – that no longer adequately capture the phenomenon as a mere deviation from traditional legal concepts. In five years' time, we will certainly be wiser, but neither as everyday people nor as academics can we remain speechless until then...
